Senate bill155

This is information regarding Contractor and Volunteer background checks and Training under SB155

Contractor must comply with all Senate Bill 155 requirements, including, but not limited to, providing District requested information for any of Contractor's employees, volunteers, or agents, who have the potential for unsupervised contact with District students, and providing requested information for new employees, volunteers, or agents before they begin work with District.

Criminal Record & Sexual Misconduct Check.  Oregon law and District policy require a criminal record check and a sexual misconduct check. Fingerprinting is required in some cases such as chaperones for overnight trips.  If fingerprinting is required, the volunteer is expected to cover the cost of the fingerprinting. Contractors complete a district SB155 criminal history check. The principal/director or their representative verifies with Risk Management (503-785-8030, ext #8546, or safety@orecity.k12.or.us) which level of check is required.  When the check is completed, the contractor will be contacted to inform them of their clearance.

Child Abuse Prevention:  When a contract requires the contractor, or contractor’s employees to have direct contact with students, the contractor agrees to train employees annually on the prevention, identification and reporting of child abuse and sexual conduct as described in Oregon Revised Statute (ORS) 339.400.  Training is available on the Oregon City School District website. This training must be complete prior to the contracted employee having direct contact with Oregon City School District students.

Safety:  To ensure the safety of District staff and students, the contractor must take reasonable precautions to ensure that individuals convicted of crimes listed in ORS 342.143 do not provide contracted services to the district.  Furthermore, the contractor shall provide timely notification to the district once they become aware that an employee providing services within the district has been arrested or charged with a crime listed in ORS 342.143, and remove said individual from district premises until the issue is resolved.

The contractor shall make an immediate report to the school administrator or a district administrator if they have information that could impact the safety or security of the school, students, or staff.  This includes but is not limited to, allegations of sexual misconduct by students, staff, contractors or volunteers, threats of violence, and restraining orders/no contact orders involving parents.  In addition, the contractor shall immediately report safety concerns to the appropriate authorities (Oregon Child Abuse Hotline, law enforcement, SafeOregon Tipline, etc).

For contracted services that occur off site:

  • The contractor shall not allow volunteers or contractors to perform services at district locations, at the contractor’s sites, or virtually who have not passed a district criminal history and sexual conduct check. Cleared volunteers shall be supervised by the provider.
